Statement of California Democratic Party Chairman John Burton on the First 2012 Presidential Debate Between President Obama and Mitt Romney Voters tuning in tonight witnessed a contrast in visions for moving our country forward. President Obama offered clear, concrete plans for continuing to build an economy where all Americans prosper and have access to opportunity, while Mitt Romney simply offered a return to the broken policies that caused the great crash. Without hesitation, or regard for American history, Romney doubled-down on the same Republican ideas thatallowed Wall Street free rein and previously left Americans at the mercy ofhealth insurance companies. The President stood firm and spoke directly to voters about moving forward together, with a plan that expands our economy from the middle out; while Romney tried to run from his $5 trillion proposed tax cut favoring the wealthy and refused to provide details on how he would accomplish his policy goals. Tonight it’s one down, two to go for President Obama and the Democrats. Assemblymember thanks Gov for recognizing the importance of bills to the North Coast Jerry Brown signs 100 percent of Chesbro’s legislation Gov. Jerry Brown has signed every bill that made it to his desk this year authored by Assemblymember Wesley Chesbro (D – North Coast). Chesbro thanked the governor for recognizing the positive impact his legislative package for 2012 will have on the First Assembly District and the State of California. “This is the first time during my service in the Legislature that every bill to reach the governor’s desk has been signed,” Chesbro said. “I appreciate that Governor Brown saw that each piece of legislation filled a need in the First Assembly District or in the state as a whole.” Following is a summary of each bill. AB 2363: Protects California’s crab fishing fleet by preventing large out-of-state vessels from dominating the annual Dungeness catch. AB1886: Helps California’s aquaculture industry prosper by funding the Aquaculture Coordinator Program within the Department of Fish and Game. AB 2284: Protects California’s forests and those who work in or use forests for recreation from environmental damage and danger from illegal drug production operations by giving law enforcement new enforcement tools. AB 1589: The California State Parks Stewardship Act of 2012 stops park closures by creating new revenue sources and helps the state’s State Parks system become more self-sustaining. (Jointly authored with Assemblymember Jared Huffman, D-San Rafael.) AB 1812: Ensures that craft brews aged in wooden barrels that previously contained wine or distilled spirits are legally classified as beer for regulatory purposes, including taxation, distribution and retail sales. AB 1162: Protects California’s heritage big game wildlife from rampant poaching by increasing the financial penalties for taking illegally these animals. AB 1492: Creates jobs, moves the California timber industry forward and protects the environment by creating a funding source to ensure timber harvest plans receive thorough environmental review under the California Environmental Quality Act. (This was an Assembly Budget Committee bill; Chesbro served as the lead advocate.) AB 2169: Reduces costs and eliminates redundancy in California’s Forest Legacy Program so the program can continue to protect environmentally important forestlands. AB 1896: In accordance with President Obama’s Affordable Care Act, allows tribal health clinics to increase access to health care in rural communities by allowing them to hire physicians licensed in other states. AB 573: Clarifies existing law relating to the servicing of wine casks by clearly allowing wineries to supply wine cask tapping equipment and, service the equipment at on-sale premises. AB 787: Ratifies the gaming compact between Coyote Valley of Pomo Indians and the State of California. AB 1900: Establishes new procedures to ensure the safe introduction of landfill gas into natural gas pipelines. AB 2196: Clarifies the eligibility of "biomethane" from landfill and digester sources for the California Renewables Portfolio Standard (RPS).Yes On Prop 39 Campaign Update Prop 39, the California Clean Energy Jobs Act, closes a tax loophole that gives out-of-state corporations an unfair advantage over businesses that employ more Californians. Eliminating this loophole will restore balance and fairness to the tax system, make California-based businesses more competitive, create new jobs and recover $1 billion a year in lost revenues. Prop 39 brings money into the General Fund, helping protect vital state programs–such as education, health and social services, public safety, and transportation. The measure also dedicates a portion of the new revenues to energy efficiency and clean energy projects for the first five years – reducing the state’s long-term energy costs and putting Californians to work. SACRAMENTO BEE ENDORSES CAMPAIGN, URGES VOTERS TO VOTE YES ON 39 This Sunday, The Sacramento Bee announced its official endorsement of Proposition 39. The Bee proclaimed that “Prop 39 is a tax code fix worthy of your ‘yes’ vote.” The Bee joins several major newspapers, such as The San Jose Mercury News, The Oakland Tribune and The Fresno Bee, in endorsing Proposition 39. According to The Sacramento Bee editorial, “Proposition 39 shows how direct democracy should work. The initiative on the Nov. 6 ballot would close a $1 billion corporate tax loophole, one that legislators are incapable of shutting…Proposition 39 is a necessary medicine to correct a mistake that lawmakers made in 2009 and haven't yet been able to rectify.” Read the full editorial HERE. SAN FRANCISCO CHAMBER OF COMMERCE VOTES TO ENDORSE PROP 39 Yesterday, the San Francisco Chamber of Commerce voted to endorse Prop 39. By voicing support for the campaign, the Chamber, and the leading California businesses it represents, are sending a message to all Californians that it is time to end the unfairness, close the loophole and bring dollars and jobs back to our state by voting yes on Prop 39. Steve Falk, President and CEO of the San Francisco Chamber of Commerce, explains their support, “The San Francisco Chamber views Prop. 39 as an important step in restoring fairness to California's tax system. California voters need to close this loophole that puts California-based businesses at a disadvantage.” The San Francisco Chamber of Commerce, which represents 1,500 member businesses and over 200,000 employees in San Francisco and across the Bay Area, joins numerous other business organizations, such as the Latin Business Association, CleanTECH San Diego and the Los Angeles Business Council in supporting Prop 39. The California Labor Federation, Service Employees International Union (SEIU) California , California Nurses Association (CNA) and the Los Angeles/Orange Counties Building & Construction Trades Council have all officially endorsed Prop 39. These labor leaders, representing millions of California workers, applaud the job-creating benefits of Prop 39. Steinberg asserts his support of Prop 39 saying, “There is no reason a California-based company that is investing in our state and creating jobs here should be paying more in taxes than an out-of-state company that is moving jobs across state lines.” He further explains that, “This initiative is about leveling the playing field for California businesses and bringing jobs back by no longer rewarding keeping jobs in neighboring states.” And, “Twenty-three other states across the nation have fixed similar issues with their tax policy. Contra Costa Times editorial: California's Prop. 39 will help keep businesses here A YES VOTE FOR PROP 39 MEANS ONE BILLION MORE DOLLARS FOR THE STATE BUDGET CDP decided to be neutral on Prop 39, hoping Speaker Perez's AB 1500 would pass the Legislature. Both AB 1500 and Prop 39 would close a billion dollar (annual) tax loophole for out of state corporations. In fact, present law encourages a California company to move their home office out of state to get a tax break. Unfortunately, AB 1500 did not pass the Senate (passed the Assembly) so now all efforts are going to pass Proposition 39. Tom Steyer, the author of Prop 39, has put $20 million in, so far, to pass it. Speaker Perez and Senate President pro Tem Steinberg have endorsed Prop 39. The Ca Labor Fed has endorsed Prop 39. The Sierra Club has endorsed Prop 39. And County Democratic Central Committees are now endorsing Prop 39, as well as Democratic Clubs. Some of the Central Committees that have already endorsed Prop 39 are: Alameda, Butte, Contra Costa, Del Norte, Glenn, Los Angeles, Madera, Modoc, Sacramento & Yuba. More will be voting to endorse this week. Ca (Schools, etc) needs to pass Prop 39 to bring in one billion more in revenue. Bob Mulholland DNC Member Gov signs Chesbro bill to protect environment, forest users from drug operations SACRAMENTO – Gov. Jerry Brown has signed AB 2284, legislation authored by Assemblymember Wesley Chesbro (D – North Coast) that gives law enforcement new tools to protect forest lands from environmental damage and the public from danger resulting from illegal drug production.
AB 2284 takes effect on Jan. 1, 2013. Help get Assembly Bill 2152 signed into law! AB 2152 (Eng) would strengthen consumer protections in California's regulation of health insurance by requiring notice to policyholders if the contract between their medical provider group or hospital and their insurer is set to terminate. The bill also requires that the Department of Insurance be notified prior to the contract termination, so that the Department can verify if the health insurer will continue to have an adequate network of medical providers in that geographic region to serve their insureds. As the sponsor of the bill, I believe that these important consumer protections will help prevent policyholders from unknowingly seeking medical care from a provider who may no longer be in their network. This information is important because patients should know whether they will be subject to higher, out-of-network costs before receiving medical treatment. In December 2011, the contract between Blue Shield and UCLA Medical Center was set to terminate. When the Department of Insurance learned of the imminent termination of the provider contract, the Department requested that Blue Shield notify affected policyholders prior to the termination, so that none of them would seek out-of-network care without knowing the cost implications of doing so. Blue Shield refused to send out notices to policyholders in advance of the contract termination and refused to cover the difference in the cost for those policyholders who went to their appointments in early January without having been noticed by the insurer that their provider was now out-of-network, except for those policyholders that were covered by the "continuity of care" law. This recent example demonstrates the undeniable need for this legislation. For the first time, Californians can register to vote online! Gov Brown signs Chesbro aquaculture bill SACRAMENTO – Gov. Jerry Brown has signed a bill by Assemblymember Wesley Chesbro (D – North Coast) to boost California’s growing aquaculture industry. AB 1886 expands the role of an industry funded aquaculture coordinator within the Department of Fish and Game (DFG). “Aquaculture is a clean, sustainable industry that has great growth potential in California, especially on the North Coast,” Chesbro said. “The coordinator program is important to the continued growth of California aquaculture, especially when it comes to helping the industry to meet high environmental standards.” “The California Aquaculture Association requested this legislation and the industry asked for an increase in licensing fees to pay for the expansion of the aquaculture coordinator’s duties,” Chesbro added. Health Insurance Rate Justification and Accountability Act is on November ballot Thank you again to those who have supported our efforts to reject excessive health insurance rate hikes. As you know, the initiative will not be put in front of voters this November. However, I am excited to share with you good news about our efforts. Today, the California Secretary of State's website reported that the Health Insurance Rate Justification and Accountability Act has enough valid signatures to qualify for the November 2014 ballot!
We have authored or sponsored four separate bills in the Legislature to rein in excessive rate hikes, but they have not become law due to the opposition of the health insurance industry. As a result, we have determined that it is important to go directly to the voters via a ballot measure to give them the chance to decide if they would like to rein in excessive health insurance rate hikes. Sincerely, DAVE JONES Insurance Commissioner Chesbro bill to cut costs in Forest Legacy Program headed to Gov SACRAMENTO – AB 2169, a bill by Assemblymember Wesley Chesbro (D – North Coast) to reduce costs and eliminate redundancy in the Forest Legacy Program, is headed to the governor’s desk after winning final approval from the Assembly today. The bill will streamline the program and save money by clarifying that conservation easements acquired through the Forest Legacy Program should be treated the same as other easement acquisitions by the Wildlife Conservation Board, and not be subject to a duplicative review by the state Public Works Board. The Forest Legacy Program was created by legislation Chesbro authored in 2000 when he served in the State Senate. The program helps forest landowners protect environmentally important forestland threatened with conversion to non-forest uses, such as residential subdivisions or commercial development, by allowing the purchase of conservation easements. “Last year when CalFire acquired a conservation easement on Sonoma County’s Baxter Ranch for the Forest Legacy Program, the purchase was forced to go through State Public Works Board, which added $18,000 to the project,” Chesbro said. “When I authored the Forest Legacy Program legislation twelve years ago, it was not the intent to involve the Public Works Board in purchases.” AB 2169 expressly exempts Forest Legacy Program conservation easement purchases from the Public Works Board’s process, and clarifies that these projects should go through the standard California Wildlife Conservation Board process, which is what the original legislation intended, Chesbro said. “The Wildlife Conservation Board’s expertise on forestry-related projects makes it uniquely qualified to oversee Forest Legacy Program purchases,” Chesbro said. “Forcing them to go through an additional process is duplicative and adds unnecessary costs to the program.” “There is no logical reason to treat conservation easements purchased with Forest Legacy funds differently than any other easement purchased by the Wildlife Conservation Board,” said Paul Mason of the Pacific Forest Trust. “The added cost and delay is pointless and wasteful. Ironically, the delays and dysfunction resulting from this duplicative process has harmed California’s competitiveness in securing federal funding for this program. Thanks to recent legislation I co-authored, this is starting to change. Assembly Bill 278 is one of several bills comprising The Homeowner Bill of Rights (HBoR), recently passed by the Legislature and signed by the Governor. The bill empowers homeowners and may help many stay in their home. Thanks to this legislation, homeowners can expect greater transparency in their dealings with banks, including a ban on foreclosure proceedings that were initiated with robo-signed documents. Further, there is now required to be a single point of contact to submit questions and paperwork. In addition, the HBoR requires that if you are in compliance with modifying a loan or attempting to do so in a timely manner - you cannot be foreclosed upon - a process known as dual-tracking. Read the rest ... Gov signs Chesbro bill to make health care more accessible in rural California SACRAMENTO – Gov. Jerry Brown has signed legislation authored by Assemblymember Wesley Chesbro (D – North Coast) that will bring more doctors to rural areas in accordance with President Obama’s Affordable Care Act. The Affordable Care Act allows Native American health programs to bring in doctors to practice at tribal clinics when they are not licensed in the state where the clinic is located, as long as they are licensed in another state. Chesbro’s AB 1896 changes California law so that it is aligned to the new federal law. “Rural communities in California suffer from a chronic shortage of health care providers,” Chesbro said. “This is especially severe in communities that depend on tribal health care clinics. Tribal clinics are open to all members of the community, not just members of the tribe, and are an important part of our health-care delivery network in rural California, particularly for low-income families.” A U.S. Civil Rights Commission report on the Native American health care delivery system found that patients who depend on tribal clinics do not receive consistent care because of high turnover of physicians. This inconsistency has led to misdiagnoses of conditions and incorrect treatment regimens. “This is unnecessary and very dangerous to patients,” Chesbro said. “It is also expensive for the state.” The Indian Health Service in California says the National Indian Health Service has a pool of physician applicants from other states who are eager to move to California and work in a tribal clinic for a contracted period of time. “According to the Health Affairs Journal, President Obama’s Affordable Care Act will result in 3.4 million more Californians gaining health insurance by 2016,” Chesbro said. “Many rural California residents who previously did not have access to health care will be insured, and it is vital we have enough providers to serve them.”Megavote, July 23, 2012 In this MegaVote for California's 1st Congressional District: Recent Congressional Votes

John Burton Sofia Pereira joins Chesbro staff as field representative in Eureka office EUREKA – Assemblymember Wesley Chesbro (D – North Coast) announced today Sofia Pereira has joined his staff as a field representative in the First Assembly District’s Eureka District Office. “Sofia came to the North Coast to attend Humboldt State and she has never left,” Chesbro said. “Like so many of us, she fell in love with the North Coast and decided to make it her home. While at HSU, Sofia became extremely involved in our community through her volunteerism and campus activities. I was fortunate to have Sofia as an intern in the Eureka district office last summer. Needless to say, she was an outstanding intern. I feel very fortunate that she will be working as my field representative serving the North Coast.” Ms. Pereira, a 2009 graduate of HSU, joins Field Representative John Woolley in the Eureka District Office, which provides services for Humboldt, Del Norte and Trinity counties. In her final year at HSU Ms. Pereira served as president of the Associated Students. She also completed an internship in the Eureka District Office of Congressman Mike Thompson and has served on the Humboldt County Human Rights Commission. She currently serves as secretary-treasurer of the Six Rivers Planned Parenthood Board of Directors and is president-elect of Lost Coast Rotaract, a service club for young people, sponsored by the Rotary Club of Eureka. “I am very pleased Sofia agreed to come to work for us and bring her tireless energy to my district staff,” Chesbro added. “The ultimate beneficiaries will be the constituents she serves.” The Eureka District Office is located at 710 E. Senate Committee approves Chesbro forest protection bill Madeleine Mello, Mendocino Sheriff Tom Allman testify to environmental threats SACRAMENTO – The Senate Public Safety Committee has approved AB 2284, a bill by Assemblymember Wesley Chesbro (D – North Coast) that seeks to protect forests, watersheds and the public by getting tougher on offenders who grow or manufacture illegal drugs on forest lands. Madeleine Melo of Fort Bragg, whose husband, Jere, was shot to death while patrolling for illicit grows deep in the forest last year, testified at the hearing to the severe environmental impacts caused by illegal drug operations on resource lands. Mendocino County Sheriff Tom Allman also testified to the pollution caused by criminal behavior in North Coast forests and the challenges law enforcement faces in preventing such operations from being established. “I want to thank Madeleine and Sheriff Allman for their testimony and helping the Committee understand the severity of this problem,” Chesbro said. “AB 2284 is focused on providing law enforcement with tools and funding to not only prevent the establishment of illicit drug production on resource and forest lands, but also addresses the funding to help cover the large cost of investigating these cases and cleaning up the sites.” AB 2284 increases the civil penalties for violations of environmental laws connected with the production of illegal substances on resource lands. It also allows law enforcement to pull over and question drivers who are transporting in plain sight irrigation supplies – commonly used in illicit grows – over unpaved roads that run through specified resource lands. These include public lands and private Timber Production Zone forest lands of 50,000 acres or larger. Owners of TPZ lands of 2,500 acres or more can also opt in to allow law enforcement to use this tool. “I continue to work with all parties during the legislative process to address their concerns, to hone in on real problems and find workable solutions,” Chesbro said. AB 2284’s next hearing is scheduled for Aug. 6 in the Senate Appropriations Committee. |
